TERMS & CONDITIONS

PROCESS: The real estate will be offered in 18 individual parcels and as a whole. The property will sell whichever way nets the most. Auction conducted on sight. Real estate offered at 9:30. Personal property to follow real estate.

DOWN PAYMENT:
A non-refundable down payment of 10% of the purchase price due day of auction with balance at closing.

NO FINANCING CONTINGENCIES: Be sure financing is in order if needed.

PURCHASE CONTRACT: All successful bidders will be required to enter into a purchase contract immediately following the close of the auction.

CERTIFICATE OF TITLE: A Certificate of Title will be posted for review at the open house and auction day. The property will be conveyed to purchaser by a marketable title free and clear of all liens and encumbrances whatsoever, except leases, reservations, conditions, easements and restrictions of record, zoning ordinances and taxes not yet payable.

MINERAL RIGHTS: Sale of the property will include any mineral rights owned by the seller.

TAXES: Taxes are $653.73 a half and will be prorated. Any CAUV tax recoupment will be a buyer’s expense.

CLOSING: Closings shall take place within 45 days of final survey approval from Ashland County if survey is required. If survey is not required the closing shall take place within 30 days.

SURVEY/ACREAGES: Parcel measurements and acreages are based on tax maps and deeds of record. Parcel measurements and acreages are approximate and may increase or decrease subject to final survey. No survey will be done if real estate is sold as a whole or in a combination where a new survey is not required.

INSPECTIONS: The real estate is not offered contingent to any inspections. All desired inspections must be made prior to bidding. Each potential bidder is responsible for conducting their own inspections. Please feel free to inspect the land at your leisure.

DEED RESTRICTIONS: BUILDING TYPE. No mobile homes, as defined in the Ohio Revised Code, are permitted on any lot. AREA REQUIREMENTS. Each residential building, depending upon the style to be erected on each lot, shall contain the following minimum square footage of “livable area”: One story or ranch-style: 1000 sq. ft. All other residences: 1400 sq. ft. “Livable area” shall not include the garage, porches, patio, terrace, utility area, furnace area, attic space, mechanical room, basement area (or in the case of a bi-level, the lowest level) or any unfinished area.  ROOF PITCH. Each residence shall have a minimum of 5:12 roof pitch.
